The agreement
These Terms of Service ("Terms") are a contract between you and MeritSlate Recruit ("MeritSlate Recruit", "we", "us") governing your use of recruit.meritslate.ai and every feature of the MeritSlate Recruit product (together, the "Service"). By creating a workspace or using the Service you accept these Terms and our Privacy Policy. If you use the Service on behalf of an agency or company, you confirm you have authority to bind it, and "you" means that organization. If you don't agree, please don't use the Service.
The service
MeritSlate Recruit is an AI-assisted screening toolkit for recruiting teams. Depending on your plan, the Service includes: bulk resume upload and parsing; ranking candidates against a job description with cited evidence; optional import from Google Drive; structured AI voice interviews with recordings, transcripts, and integrity signals; and client-ready exports and share links.
AI screening & your decisions
Decision support, not decisions
The Service produces decision support — scores, summaries, rankings, and signals for a human to review. It does not and must not make hiring decisions by itself.
- You agree that a human reviews AI output before any decision that affects a candidate, and that you will not represent MeritSlate Recruit output to candidates or clients as an automated hiring decision.
- You are responsible for complying with the employment, anti-discrimination, and AI-use laws that apply in your jurisdictions — including any notice or audit obligations that apply to automated employment decision tools where you operate.
- Integrity signals are neutral observations for human review. You agree not to present them to anyone as proof of misconduct.
Where AI screening and AI interviews must not be used
Some places have AI-hiring rules the Service does not yet satisfy. Until this section says otherwise, you agree not to use AI screening or AI interviews:
- for positions based in New York City — NYC Local Law 144 requires an independent bias audit and candidate notices that the Service does not currently provide;
- for candidates located in Illinois — the Illinois Artificial Intelligence Video Interview Act and the Biometric Information Privacy Act impose consent, deletion and biometric restrictions the Service does not currently support.
Elsewhere, the notice and record-keeping obligations that apply to automated employment decision tools remain yours; our AI system documentation describes what the Service does and does not do, so you can meet them.
Candidate data responsibilities
You upload and collect candidate data through the Service; between you and us, you are its controller. You represent and warrant that:
- you have a lawful basis and, where required, the candidate's consent to process each resume and to invite each candidate to an interview;
- you provide candidates any privacy notices your law requires, and you honor their access, correction, and deletion requests;
- you will not upload data you have no right to hold — including scraped resumes or files obtained without authorization.
Workspaces & accounts
- Keep your sign-in email secure — one-time codes sent to it grant access to your workspace. You are responsible for activity in your workspace.
- Plan limits (jobs, resumes per job, monthly screenings, interviews) are enforced server-side and are part of these Terms. Fair-use limits protect the Service from abuse.
Plans, trials & billing
- Paid plans are monthly subscriptions billed in advance through our payment processor, Dodo Payments. Prices and per-plan caps are shown at checkout.
- New workspaces may start a 7-day free trial with no card and no charge. Nothing starts by itself: the trial ends on its own, and a paid subscription begins only when you choose a plan and complete checkout.
- Subscriptions renew automatically each period until cancelled. You can cancel any time; cancellation takes effect at the end of the current billing period, and you keep access until then. The current period isn't refunded or pro-rated.
- If a renewal payment fails we may retry it and will notify you; continued failure downgrades or suspends the workspace.
Refunds & chargebacks
All sales are final, and all payments are non-refundable. Because paid features grant immediate access to metered AI processing, we don't offer refunds, credits, or pro-rated returns for partial periods, unused quota, or forgotten cancellations.
A few narrow exceptions apply: we will always issue a refund where the law of your jurisdiction requires one, or where we charged you in error. When a payment is refunded for any reason, what it paid for is revoked — the associated paid access ends.
If you believe a charge is wrong, contact hi@meritslate.ai before disputing it with your bank — chargebacks filed without contacting us first may result in workspace suspension while we investigate.
Google Drive import
- The optional import connects your own Google account through Google's consent flow and is subject to Google's own terms. We access only the files you select, as described in the Privacy Policy, and our use of Google user data adheres to the Google API Services User Data Policy, including its Limited Use requirements.
- Only connect a Drive you are authorized to use for recruiting, and only import files you have the right to process.
AI interviews & recordings
- Candidates see what will be recorded and must consent in the interview room before an interview starts. You agree not to ask us to interview a candidate covertly.
- Where your jurisdiction requires additional notice or consent for recording, obtaining it is your responsibility.
- Recordings and transcripts exist for human review of the specific role's screening; use them for other purposes only if your law allows it.
Acceptable use
You agree not to:
- use the Service to discriminate unlawfully, or configure job requirements as a proxy for protected characteristics;
- probe, overload, scrape, or reverse-engineer the Service, or bypass plan caps, rate limits, or security controls;
- upload malware or content you have no right to process;
- resell or white-label the Service except through features we provide for that purpose;
- use the Service to build a competing dataset or model.
Your content & our IP
- Your workspace content — resumes, jobs, interview recordings, results — remains yours. You grant us the license needed to host, process, and display it to operate the Service, and nothing more. We never use it to train AI models.
- The Service itself — software, design, models of operation, trademarks — is ours. These Terms grant you a limited, non-exclusive, non-transferable right to use it while your subscription is active.
Disclaimers & liability
The Service is provided "as is". AI output can be incomplete or wrong; resumes can parse imperfectly; scores are estimates against the job description you provided, not judgments of any person. We do not warrant that any candidate is suitable, that output is error-free, or that the Service will be uninterrupted.
To the maximum extent the law allows: we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data; and our total liability for all claims in any 12-month period is limited to the amounts you paid us for the Service in that period. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
You will indemnify us against third-party claims arising from candidate data you had no right to process or from your breach of the candidate-data and acceptable-use sections above.
Termination
You can stop using the Service and cancel at any time. We may suspend or terminate a workspace that materially breaches these Terms, creates risk for candidates or the Service, or fails to pay. On termination your right to use the Service ends; workspace data is deleted as described in the Privacy Policy.
Changes to these terms
We may update these Terms as the product evolves. For material changes we notify workspace owners by email before the change takes effect; continued use after the effective date means the updated Terms apply.
Governing law
These Terms are governed by the laws of the jurisdiction in which MeritSlate Recruit is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction — except where the consumer-protection law of your home jurisdiction grants you non-waivable rights or venue.
